§ 11-7-13 - Acceptance of gratuity by employees of banking division of department of business regulation.

SECTION 11-7-13

   § 11-7-13  Acceptance of gratuity byemployees of banking division of department of business regulation. – (a) No person who is an employee of the banking division of the department ofbusiness regulation or an employee of the department with jurisdiction over thebanking division, shall accept a gratuity from a financial institution governedby title 19 or from any officer, director, or employee of the financialinstitution.

   (b) If the gratuity, so accepted, is valued at less than onehundred dollars ($100), the person who violates this section shall be guilty ofa misdemeanor and shall be imprisoned for not more than one year, or fined notmore than one thousand dollars ($1,000), or both.

   (c) If the gratuity, so accepted, is valued at one hundreddollars ($100) or more, or if the aggregate of the gratuities so acceptedwithin a year equal or exceed one hundred dollars ($100), the person whoviolated this section shall be guilty of a felony and shall be imprisoned notmore than three (3) years, or fined not more than twenty-five thousand dollars($25,000) or three (3) times the amount of the gratuity so given, whichever isgreater, or both.
