§ 12-9-12.1 - Extradition of juveniles.

SECTION 12-9-12.1

   § 12-9-12.1  Extradition of juveniles.– (a) When the extradition of a child under the age of eighteen (18) years of ageis demanded by another state, the child shall be summoned to appear or orderedto appear before the family court pursuant to the provisions of chapter 1 oftitle 14.

   (b) The provisions of § 12-9-12 shall apply to thehearing conducted by the family court. In addition when the other state seeksthe extradition of the child for trial as an adult, the family court shalldetermine whether or not the child would have been tried as an adult in thisstate if charged with the offense alleged to have been committed in the otherstate. The family court shall apply the provisions of §§ 14-1-7 and14-1-7.1 in making the determination.

   (c) No person under the age of eighteen (18) years of ageshall be extradited for trial in another state as an adult unless a justice ofthe family court determines that the person would have been tried as an adultin the state of Rhode Island.
