§ 12-9-31 Filing of consent –Delivery of prisoner to extradition agents. – If and when consent pursuant to § 12-9-30 has been duly executed it shallbe immediately forwarded to the office of the governor of this state and filedin that office. The judge shall direct the officer having the person in custodyto immediately deliver the person to the duly accredited agent or agents of thedemanding state and shall deliver or cause to be delivered to the agent oragents a copy of his or her consent; provided, that nothing in this section and§ 12-9-30 shall be deemed to limit the rights of the accused person toreturn voluntarily and without formality to the demanding state, nor shall thiswaiver procedure be deemed to be an exclusive procedure or to limit the powers,rights, or duties of the officers of the demanding state or of this state.
