§ 2-12-19 Enforcement and prosecutions.– It is the duty of the director of the department of environmental management orhis or her duly authorized representative to enforce the provisions of thischapter and chapter 11 of this title and to prosecute any person, firm orcorporation who, in his or her opinion, is guilty of the violation of any ofthe provisions of this chapter and in all prosecutions the director or his orher authorized representative is not required to enter into any recognizance orto give surety for costs. It is the duty of the attorney general to conduct theprosecution brought by the director under the provisions of this chapter andchapter 11 of this title.
