§ 2-7-17 Seizure, condemnation, and sale.– Any lot of commercial fertilizer not in compliance with the provisions of thischapter shall be subject to seizure on complaint of the director to a court ofcompetent jurisdiction in the area in which the commercial fertilizer islocated. In the event the court finds the commercial fertilizer to be inviolation of this chapter and orders the condemnation of the commercialfertilizer, it shall be disposed of in any manner consistent with the qualityof the commercial fertilizer and the laws of the state: provided, that in noinstance shall the disposition of the commercial fertilizer be ordered by thecourt without first giving the claimant an opportunity to apply to the courtfor release of the commercial fertilizer or for permission to process orrelabel the commercial fertilizer to bring it into compliance with this chapter.
