§ 23-17.4-21.1 - Assisted living administrator certification board.

SECTION 23-17.4-21.1

   § 23-17.4-21.1  Assisted livingadministrator certification board. – (a) Within the department there is established an assisted living administratorcertification board to be appointed by the director of health with the approvalof the governor consisting of seven (7) members as follows: two (2) members ofthe board are persons with at least five (5) years experience in operating anassisted living residence; one member of the board is an active assisted livingadministrator who is not an assisted living owner; two (2) members are personsrepresenting assisted living consumers or family members; and two (2) membersare representatives of the assisted living industry or are assisted livingemployees.

   (b) Members shall be appointed to three (3) year terms. Nomember shall serve for more than two (2) terms. The director, with the approvalof the governor, shall appoint all vacancies, as they occur for the remainderof a term or until a successor is appointed.

   (c) The director may remove, after a hearing and with theapproval of the governor, any member of the board for neglect of any dutyrequired by law or for any incompetency, unprofessional or dishonorableconduct. Before beginning a term, a member shall take an oath prescribed by lawfor state officers, a record of which shall be filed with the secretary ofstate.

   (d) The director shall appoint a chairperson.

   (e) Four (4) members of the board shall constitute a quorum.

   (f) The board shall serve without compensation.

   (g) Meetings of the board shall be called by the director orthe director's designee, or a majority of the board members.

   (h) The director shall provide for a staff person of thedepartment to serve as an administrative agent for the board.
