§ 23-19.9-11 - Severability and construction.

SECTION 23-19.9-11

   § 23-19.9-11  Severability andconstruction. – (a) The provisions of this compact shall be severable and if any phrase,clause, sentence or provision of this compact is declared by a court ofcompetent jurisdiction to be contrary to the Constitution of any party state orof the United States or the applicability thereof to any government, agency,person or circumstance is held invalid, the validity of the remainder of thiscompact and the applicability thereof to any other government, agency, personor circumstance shall not be affected thereby. If any provision of this compactshall be held contrary to the Constitution of any state participating therein,the compact shall remain in full force and effect as to the state affected aswell as to all severable matters. The provisions of this compact shall beliberally construed to give effect to the purposes thereof.

   (b) Nothing in this compact shall be construed to authorizethe Commission or any party state to waive the provisions of the compact or therequirements adopted pursuant to it.
