SECTION 23-77-2

   § 23-77-2  Establishment of the healthcareinformation technology and infrastructure development fund. – (a) There is established in the department of health, the healthcareinformation technology and infrastructure development fund to be administeredby the director of the department of health for the purpose of promoting thedevelopment and adoption of healthcare information technologies designed toimprove the quality, safety and efficiency of healthcare services and thesecurity of individual patient data.

   (b) Moneys in the fund shall be used for projects authorizedby the director of health and may be expended by contract, loan, or grant, todevelop, maintain, expand, and improve the state's healthcare informationtechnology infrastructure and to assist healthcare facilities and healthservice providers in adopting healthcare information technologies shown toimprove healthcare quality, safety or efficiency. Such projects shallincorporate the goal of maintaining the security and confidentiality ofindividual patient data, and separate projects for that purpose may also beauthorized from the fund. The director of health shall develop criteria for theselection of projects to be funded from the fund in consultation with thehealthcare information technology and infrastructure advisory committee createdin § 23-77-4.

   (c) Any moneys provided by loan shall be disbursed forperiods not exceeding twenty-five (25) years and at an annual rate of interestnot exceeding five percent (5%).

   (d) The director of the department of health, in consultationwith the state healthcare information technology advisory committee, shallestablish criteria for eligible healthcare information technology andinfrastructure projects to be funded under this chapter.
