§ 27-12.2-4 - Confidentiality of proceedings and records.

SECTION 27-12.2-4

   § 27-12.2-4  Confidentiality of proceedingsand records. – (a) Notwithstanding any other provision of law and except as set forth in thissection, proceedings, hearings, notices, correspondence, reports, records, andother information in the possession of the commissioner or the department ofbusiness regulations relating to the supervision of any insurer areconfidential except as provided by this section.

   (b) The personnel of the department of business regulationsshall have access to these proceedings, hearings, notices, correspondence,reports, records, or information as permitted by the commissioner.

   (c) The commissioner may open the proceedings or hearings ordisclose the notices, correspondence, reports, records, or information to adepartment, agency or instrumentality of this or another state of the UnitedStates if the commissioner determines that the disclosure is necessary orproper for the enforcement of the laws of this or another state of the UnitedStates.

   (d) The commissioner may open the proceedings or hearings ormake public the notices, correspondence, reports, records, or other informationif the commissioner deems that it is in the best interest of the public or inthe best interest of the insurer, its insureds, creditors, or the generalpublic.

   (e) This section does not apply to hearings, notices,correspondence, reports, records, or other information obtained upon theappointment of a receiver for the insured by a court of competent jurisdiction.
