SECTION 27-16-5

   § 27-16-5  Acts constituting appointment ofattorney to receive process. – Any of the following acts in this state, effected by mail or otherwise, by anunauthorized foreign or alien insurer is equivalent to and shall constitute anappointment by the insurer of the insurance commissioner and the commissioner'ssuccessor or successors in office to be the insurer's true and lawful attorney,upon whom may be served all lawful process in any action, suit, or proceedinginstituted by or on behalf of an insured or beneficiary arising out of thecontract of insurance, and the act shall be signification of its agreement thatservice of process is of the same legal force and validity as personal serviceof process in this state upon the insurer: (1) the issuance or delivery ofcontracts of insurance or reinsurance to residents of this state or tocorporations authorized to do business in this state; (2) the solicitation ofapplications for the contracts; (3) the collection of premiums, membershipfees, assessments or other considerations for the contracts; or (4) any othertransaction of insurance business.
