   § 27-44-18  Penalties. – (a) The director may, if he or she finds that any person or organization hasviolated any provision of this chapter, impose a penalty of not more than onethousand dollars ($1,000) for each violation, but if the director finds theviolation to be willful, he or she may impose a penalty of not more than fiftythousand dollars ($50,000) for each violation. The penalties may be in additionto any other penalty provided by law.

   (b) For the purposes of this section, any insurer using arate for which the insurer has failed to file the rate, supplementary rateinformation, or supporting information, as required by this chapter or by anyrules and regulations that the director may promulgate, has committed aseparate violation for each day that failure continues.

   (c) The director may suspend or revoke the license of anyrating organization or insurer which fails to comply with an order of thedirector within the time limited by the order, or any extension of the orderwhich the director may grant.

   (d) The director may determine when a suspension of licenseshall become effective and it shall remain in effect for the period fixed byhim or her, unless he or she modifies or rescinds the suspension, or until theorder upon which the suspension is based is modified, rescinded, or reversed.

   (e) No penalty shall be imposed and no license shall besuspended or revoked except upon a written order of the director, stating hisor her findings, made after a hearing.
