§ 28-42-38.2 - Income and eligibility verification.

SECTION 28-42-38.2

   § 28-42-38.2  Income and eligibilityverification. – (a) The department of labor and training will participate in the income andeligibility verification procedures as required by 42 U.S.C. § 1302b-7,which provides for the exchange of information among agencies administeringfederally assisted programs for aid to families with dependent children,Medicaid, food stamps, supplemental security income, unemployment insurance,and any other state program under a plan approved under Title I, X, XIV, or XVIof the Social Security Act, 42 U.S.C. § 301 et seq., 1201 et seq., 1351 etseq., or 1381 et seq., respectively.

   (b) Notwithstanding any other provisions of this chapter, thedirector will provide, upon request: (1) quarterly wage information to allauthorized agencies for income and eligibility verification purposes and,further, to the appropriate state or local child support enforcement agencyoperating pursuant to a plan described in 42 U.S.C. § 654 which has beenapproved by the Secretary of Health and Human Services under Part D of Title IVof the Social Security Act, 42 U.S.C. § 651 et seq. (2) quarterly wageinformation for child support enforcement purposes to the Department of Healthand Human Services in accordance with United States P.L. 100-485, FamilySupport Act of 1988; and (3) quarterly wage information to the Department ofHousing and Urban Development and to authorized representatives of publichousing agencies in accordance with the Stewart B. McKinney Homeless AssistanceAct, 42 U.S.C. § 11301 et seq. This information shall be made availableonly to the extent necessary for the valid administrative needs of theauthorized agencies and all agencies requesting this data shall protect it fromunauthorized disclosures. The department shall be reimbursed by the agenciesrequesting the information for the costs incurred in providing the information.
