SECTION 31-32-13

   § 31-32-13  Exception when insurer liable.– No license, registration, or nonresident's operating privilege of any personshall be suspended under the provisions of this chapter if the division ofmotor vehicles shall find that an insurer was obligated to pay the judgmentupon which the suspension is based, at least to the extent and for the amountsrequired in this chapter, but has not paid the judgment for any reason. Afinding by the division of motor vehicles that an insurer is obligated to pay ajudgment shall not be binding upon the insurer and shall have no legal effectwhatever except for the purpose of administering this section. Whenever in anyjudicial proceedings it shall be determined by any final judgment, decree, ororder than an insurer is not obligated to pay the judgment, the division ofmotor vehicles, notwithstanding any contrary finding previously made by it,shall immediately suspend the license and registration and any nonresident'soperating privilege of any person against whom the judgment was rendered, asprovided in § 31-32-10.
