§ 31-47.2-2 - Inspection requirement.

SECTION 31-47.2-2

   § 31-47.2-2  Inspection requirement. –(a) The administrator of the division of motor vehicles shall, at the directionof the director of the department of revenue and in coordination with thedepartment of environmental management, establish rules and regulations anddevelop testing techniques and emission standards for motor vehicles subject tothe provisions of this chapter.

   (b) Motor vehicles subject to this chapter shall bedetermined by regulation, and shall include, but not necessarily be limited to,all diesel powered trucks and buses of all model years and over eight thousandfive hundred pounds (8,500 lbs.) gross vehicle weight rating that operate onthe highways of Rhode Island.

   (c) Standards for opacity of emissions shall be promulgatedfor all subject vehicles.

   (d) In establishing such standards, the administrator shallreview standards in effect in other states in the northeast United States andto the extent practicable shall establish standards consistent with standardsin other states.

   (e) Emissions inspections may be performed at roadside or inconjunction with any safety or weight inspection.

   (f) Any motor vehicle which is inspected and found not tocomply with the standards for heavy-duty diesel motor vehicle emissions shallbe repaired within forty-five (45) consecutive calendar days after theinspection so as to comply with the standards for heavy-duty diesel motorvehicle emissions, or not be operated on the highways of the state.
