SECTION 37-2-13

   § 37-2-13  Procurement regulations. –(a) Within sixty (60) days after July 1, 1989, the chief purchasing officershall promulgate the initial state purchasing regulations in accordance withcurrent policies and procedures. The initial regulations may be promulgated onan interim basis and shall be promulgated on a final basis in accordance withchapter 35 of title 42.

   (b) All additions, deletions, or other modifications of thefinal purchasing regulations issued pursuant to subsection (a) of this sectionshall be promulgated by the chief purchasing officer in accordance with anyapplicable provisions of this chapter and chapter 35 of title 42.

   (c) The chief purchasing officer shall not delegate his orher power to issue the state purchasing regulations under subsections (a) and(b) of this section to any other person or agency and no state purchasingregulations shall be issued except as approved by the chief purchasing officer.

   (d) No state purchasing regulation shall change in any way acontract commitment by the state nor of a contractor to the state which was inexistence on the effective date of the regulation.

   (e) The provisions of state purchasing regulationspromulgated as authorized herein shall be considered to be incorporated byoperation of law in all state contracts.

   (f) Contract provisions and contracts entered into inviolation of regulations shall be void ab initio.
