§ 39-20-5 - Regulation of foreign electric utilities.

SECTION 39-20-5

   § 39-20-5  Regulation of foreign electricutilities. – (a) A foreign electric utility, in order to procure a certificate of authorityto transact business in this state pursuant to this chapter, shall makeapplication therefor to the secretary of state pursuant to the provisions of§§ 7-1.2-1405 and 7-1.2-1406 and shall be subject to §§7-1.2-1403 – 7-1.2-1418, 7-1.2-1501 and 7-1.2-1601 – 7-1.2-1604.

   (b) A foreign public utility which has received a certificateof authority to transact business in this state pursuant to this chapter:

   (1) Shall, before owning or operating an electric generatingfacility in this state, notify the commission of the action to be taken by it;

   (2) Shall thereafter furnish to the commission annually acopy of the annual report filed by it with the utility regulatory agency of thestate of its domicile or principal locus; and

   (3) Shall furnish to the commission from time to time suchother information with respect to its activities in the state as the commissionmay reasonably request.
