   § 4-5-6  Payment for condemned animals– Prerequisites. – In the case of any bovine animal condemned as having any infectious,contagious, or communicable disease considered dangerous to livestock or publichealth, upon receipt of a post mortem examination, conducted by a veterinarianapproved by the department of environmental management or one licensed topractice veterinary medicine in this state, the state may pay to the owner anindemnity not to exceed the difference between the appraised value of eachanimal destroyed less the net salvage received by the owner and any fundsreceived from federal indemnity payments. No payment shall exceed five hundreddollars ($500), and any joint state federal indemnity payments plus salvageshall not exceed the appraised value of the animals. No payment shall be madefor any animal that is condemned and killed if that animal is from a herd thathas not been maintained in accordance with the rules, regulations, andstandards of the state, and of any state and federal regulations for thesuppression of bovine disease or if that animal has been imported into thisstate where there has been no compliance with the rules, regulations, andstandards of the state governing the requirements for importation. The premiseswhere the diseased animal has been kept shall be thoroughly cleansed anddisinfected according to the regulations of the department of environmentalmanagement.
