SECTION 41-9.1-16

   § 41-9.1-16  Gaming supplier permits.– (a) The state lottery division shall issue a gaming supplier permit to suitablepersons who supply, sell, lease or repair, or contract to supply, sell lease orrepair gaming devices, equipment, and supplies to the holder of a license. Aperson shall not supply, sell, lease, or repair, or contract to supply, sell,lease or repair, gaming devices, equipment and supplies unless then possess avalid gaming supplier permit.

   (b) Gaming devices or supplies may not be distributed to theholder of a license unless such devices or supplies conform to rules adopted bythe state lottery division.

   (c) A gaming supplier shall furnish to the state lotterydivision a list of any gaming devices and supplies offered by the gamingsupplier for sale or lease in connection with games authorized under thischapter. A gaming supplier shall keep books and records for the furnishing ofgaming devices and supplies to gaming operations separate and distinct from anyother business that the gaming supplier might operate. A gaming supplier shallfile an annual return with the state lottery division listing all sales andleases. A gaming supplier shall permanently affix its name to all its gamingdevices and supplies for gaming operations unless otherwise authorized by thestate lottery division. Any gaming supplier's gaming devices or supplies, whichare used by any person in unauthorized gaming operations, shall be forfeited tothe state lottery division. The holder of a license may own its own gamingdevices and supplies. Each gaming supplier and the holder of a license shallfile an annual report with the state lottery division listing its inventoriesof gaming devices, equipment, and supplies.

   (d) The initial fee for a gaming supplier permit issued underthe provisions of this section is three thousand dollars ($3,000), and therenewal fee shall be one thousand dollars ($1,000). This fee is required to besubmitted at the time of application and on the anniversary date of theissuance of the permit thereafter. The state lottery division may assess thegaming supplier any costs incurred in testing and approving any devices orsupplies.

   (e) Except as is otherwise required under § 41-9.1-17,non-gaming suppliers shall not be required to obtain a permit from the statelottery division; provided, however, the state lottery division may callforward any such non-gaming supplier and require a finding of suitability ifnecessary to protect the public interest.
