§ 44-49-2 Definitions. – (a) "Controlled substance" means any drug or substance, whether real orcounterfeit, as defined in § 21-28-1.02(7), that is held, possessed,transported, transferred, sold, or offered to be sold in violation of RhodeIsland laws. "Controlled substance" does not include marijuana.
(b) "Dealer" means a person who in violation of Rhode Islandlaw manufactures, produces, ships, transports, or imports into Rhode Island orin any manner acquires or possesses more than forty-two and one half (42.5)grams of marijuana, or seven (7) or more grams of any controlled substance, orten (10) or more dosage units of any controlled substance which is not sold byweight. A quantity of marijuana or a controlled substance is measured by theweight of the substance whether pure or impure or dilute, or by dosage unitswhen the substance is not sold by weight, in the dealer's possession. Aquantity of a controlled substance is dilute if it consists of a detectablequantity of pure controlled substance and any excipients or fillers.
(c) "Marijuana" means any marijuana, whether real orcounterfeit, as defined in § 21-28-1.02(26), that is held, possessed,transported, transferred, sold, or offered to be sold in violation of RhodeIsland laws.
