§ 45-27-11 - Remedies of obligee.

SECTION 45-27-11

   § 45-27-11  Remedies of obligee. – An obligee of the authority has the right, in addition to all other rightswhich may be conferred on the obligee, subject only to any contractualrestrictions binding upon the obligee:

   (1) By mandamus, suit, action, or proceeding in law or equity(all of which may be joined in one action) to compel the authority, and itscommissioners, officers, agents, or employees to perform each and every term,provision, and covenant contained in any contract of the authority, and torequire the carrying out of any or all covenants and agreements of theauthority and the fulfillment of all duties imposed upon the authority bychapters 25 – 27 of this title.

   (2) By suit, action, or proceeding in equity to enjoin anyacts or things which may be unlawful, or the violation of any of the rights ofan obligee of the authority.

   (3) By suit, action, or proceeding in any court of competentjurisdiction to cause possession of any housing project or any part of it to besurrendered to any obligee having the right to possession pursuant to anycontract of the authority.
