§ 45-30-2 - Definitions.

SECTION 45-30-2

   § 45-30-2  Definitions. – The following terms, wherever used or referred to in this chapter, have thefollowing respective meanings, unless a different meaning clearly appears fromthe context:

   (1) "Administration" means any and all undertakings necessaryfor management, operation, or maintenance, in connection with any project, andincludes the leasing of any project (in whole or in part) from the federalgovernment.

   (2) "Development" means any and all undertakings necessaryfor the planning, land acquisition, demolition, financing,

   construction, or equipment in connection with a project(including the negotiation or award of contracts), and includes the acquisitionof any project (in whole or in part) from the federal government.

   (3) "Federal government" means the United States of Americaor any agency or instrumentality, corporate or otherwise, of the United Statesof America.

   (4) "Housing authority" means any housing authority createdor established or hereafter created or established under the provisions of theHousing Authorities Law, chapters 25 – 27 of this title, or under theprovisions of §§ 45-30-7 – 45-30-9.

   (5) The development of a project is deemed to be "initiated"if a housing authority has issued any bonds, notes, or other obligations withrespect to financing the development of that project of the housing authority,or has contracted with the federal government with respect to the exercise ofpowers under this chapter in the development of that project of the federalgovernment.

   (6) "National defense period" means the period, as determinedby a housing authority (which determination is conclusive in any suit, action,or proceeding), during which there exists or impends in the locality an acuteshortage of safe and sanitary dwellings for persons engaged in national defenseactivities.

   (7) "Persons engaged in national defense activities" include:persons in the military service of the United States; employees of theDepartment of Defense; and workers engaged or to be engaged in activitiesconnected with and essential to national defense; and the families of thosepersons who are living with them.
