SECTION 45-57-7

   § 45-57-7  Assessments. – (a) The electors of the district, at annual or special meeting of the district,have the power to order the imposition and collection of thosemonetaryassessments upon lots of record with the district which they deem necessary forthe payment of common expenses incurred or to be incurred in fulfillment of thepurposes of the district and of this chapter.

   (b) Assessments shall be determined for each lot of recordequally, without regard to the lot location, size or value of the land or ofany improvements thereon, and without regard to the benefit of any individuallot owner.

   (c) The amount of assessments hereunder shall be determinedby a majority vote of the electors voting, upon recommendation of the board ofdirectors and consideration of the treasurer's annual report.

   (d) Notwithstanding subsections (a) through (c), any commonexpense incurred by the district as the result of misconduct by an individuallot owner or owners may be assessed exclusively against the offending lot owneror owners.
