§ 46-16-1.3 - Concurrence in additional powers.

SECTION 46-16-1.3

   § 46-16-1.3  Concurrence in additionalpowers. – (a) This state hereby concurs in the conferring of any powers or duties on theNew England interstate water pollution control commission by other states, inaddition to those conferred by provisions of the New England Interstate WaterPollution Control Compact. This concurrence is pursuant to article II of thatcompact.

   (b) The concurrence is subject to the following limitations:

   (1) Unless this state specifically confers a power or duty onthe commission, other than one conferred by the compact itself, no financial orother burden or duties shall be placed upon this state, or any agency, officer,or subdivision thereof by reason of the conferring or exercise of the power orduty. At any time the governor shall have the power to make inquiry of thecommission and to examine its books and records in order to ascertain the stateof compliance with this chapter.

   (2) The rights, privileges, and responsibilities of thisstate with respect to the New England Interstate Water Pollution ControlCompact and the commission established thereby, shall not be limited orimpaired.

   (3) The commission shall include in its annual report to thegovernor and the legislature of this state a full account of any additionalpowers or duties administered by it.
