SECTION 5-34-29

   § 5-34-29  Penalty for violations. –(a) It is a misdemeanor for any person, firm, corporation, or association to:

   (1) Sell or fraudulently obtain or furnish any nursingdiploma, license, or record or aid or abet in this;

   (2) Practice nursing as defined by this chapter and undercover of any diploma, license, or record illegally or fraudulently obtained, orsigned, or issued unlawfully or under fraudulent representation;

   (3) Practice nursing as defined by this chapter unlesslicensed to do so under the provisions of this chapter;

   (4) Use in connection with his or her name any designationtending to imply that he or she is a professional nurse or a licensed practicalnurse unless licensed to practice under the provisions of this chapter;

   (5) Practice nursing during the time his or her licenseissued under the provisions of this chapter is suspended or revoked;

   (6) Conduct a basic professional nursing education program ora practical nursing education program unless it has been approved by the boardof nurse registration and nursing education; and

   (7) Violate any of the provisions of this chapter.

   (b) The misdemeanor is punishable by a fine of not less thanthree hundred dollars ($300) for the first offense. Each subsequent offense ispunishable by a fine of not less than five hundred dollars ($500), or byimprisonment of not more than one year, or by both the fine and imprisonment.
