8-30-329. Leaves of absence for career service positions.

If any employee who is an assistant commissioner, or its equivalent, or a director or division chief including the full-line division chief to a statewide program, or a chief of a division supervising several line service units or equivalent, has served at least five (5) continuous years in the career service immediately before promotion to such a position in the executive service, such employee shall be granted leave of absence without pay from the career service for the duration of such appointment, for a period not to exceed five (5) years. Any such person who left such an executive service position in good standing and is not eligible for retirement shall have the option of returning to a career service position of the same class or rank as the last civil service position in which the person held status as a regular employee, the duties of which the person is qualified to perform, if the employee exercises this option within six (6) months following termination from the executive service position. The placement of any appointee in accordance with the provisions of this section may not be made to a position which would cause the separation of any other regular civil service employee.
