§ 10.1-556. Determination of Board.

The Board shall publish the result of the referendum and shall thereafterconsider and determine whether the continued operation of the district withinthe defined boundaries is administratively practicable and feasible. If theBoard determines that the continued operation of the district isadministratively practicable and feasible, it shall record the determinationand deny the petition. If the Board determines that the continued operationof the district is not administratively practicable and feasible, it shallrecord its determination and certify the determination to the districtdirectors. In making its determination the Board shall consider theproportion of the votes cast in favor of the discontinuance of the districtto the total number of votes cast, the probable expense of carrying onerosion control operations within the district, and other relevant economicand social factors. However, the Board shall not have authority to determinethat the continued operation of the district is administratively practicableand feasible unless at least a majority of the votes cast in the referendumhave been cast in favor of the continuance of such district.
