§ 15.2-4517.1. Background checks of applicants and employees.

A. Any commission created pursuant to this chapter may require any individualwho is offered a position of employment with the commission, or with anycontractor of the commission when such individual is to be assigned todirectly provide transit services to the public under a contract with thecommission, to submit to fingerprinting and to provide personal descriptiveinformation to be forwarded along with the individual's fingerprints throughthe Central Criminal Records Exchange to the Federal Bureau of Investigationfor the purpose of obtaining criminal history record information regardingsuch individual. The commission shall bear all costs of obtaining criminalhistory record information regarding such individual, including expensesincurred by the Virginia State Police in connection with such fingerprintingor criminal records check. The commission may require such individual orcontractor to reimburse the commission for the cost of the fingerprinting ora criminal records check or both.

B. The Central Criminal Records Exchange, upon receipt of an individual'srecord or notification that no record exists, shall make a report to thecommission's chief administrative officer, who must belong to a governmentalentity. The information shall not be disseminated except as provided for inthis section.
