§ 18.2-261. Monetary penalty.

Any person licensed by the State Board of Pharmacy who violates any of theprovisions of the Drug Control Act (§ 54.1-3400 et seq.) or of this article,and who is not criminally prosecuted, shall be subject to the monetarypenalty provided in this section. If, by a majority vote, the Board shalldetermine that the respondent is guilty of the violation complained of, theBoard shall proceed to determine the amount of the monetary penalty for suchviolation, which shall not exceed the sum of $1,000 for each violation. Suchpenalty may be sued for and recovered in the name of the Commonwealth.
