§ 2.2-5300. Definitions.

As used in this chapter, unless the context requires a different meaning:

"Council" means the Virginia Interagency Coordinating Council createdpursuant to § 2.2-2664.

"Early intervention services" means services provided through Part C of theIndividuals with Disabilities Education Act (20 U.S.C. § 1431 et seq.), asamended, designed to meet the developmental needs of each child and the needsof the family related to enhancing the child's development and provided tochildren from birth to age three who have (i) a 25 percent developmentaldelay in one or more areas of development, (ii) atypical development, or(iii) a diagnosed physical or mental condition that has a high probability ofresulting in a developmental delay. Early intervention services provided inthe child's home and in accordance with this chapter shall not be construedto be home health services as referenced in § 32.1-162.7.

"Participating agencies" means the Departments of Health, of Education, ofMedical Assistance Services, of Behavioral Health and Developmental Services,and of Social Services; the Departments for the Deaf and Hard-of-Hearing andfor the Blind and Vision Impaired; the Virginia Office for Protection andAdvocacy; and the Bureau of Insurance within the State Corporation Commission.
