§ 30-198. (Expires July 1, 2012) Advisory Council on Career and TechnicalEducation; purpose; membership; compensation and expenses; quorum.

A. The Advisory Council on Career and Technical Education (Council) isestablished as an advisory council in the legislative branch of stategovernment to recommend an integrated and coordinated multiagency approachfor the delivery of quality career and technical education programs andservices in the public schools.

B. The Council shall consist of 18 members, to be appointed as follows: onemember each of the House Committees on Finance, Education, andAppropriations, and two members of the House of Delegates at-large, to beappointed by the Speaker of the House of Delegates in accordance with theprinciples of proportional representation contained in the Rules of the Houseof Delegates; one each of the Senate Committees on Finance and Education andHealth, and one member of the Senate at-large, to be appointed by the SenateCommittee on Rules; four representatives of business and industry fromcompanies of varying size, geographically distributed from among the eightsuperintendents' regions of the Commonwealth, to be appointed by theGovernor; and the President of the Board of Education, the Chancellor of theVirginia Community College System, the Chairman of the Board of CorrectionalEducation, the Secretary of Commerce and Trade, the Secretary of Education,and the Secretary of Technology or their designees shall serve as ex officiomembers with full voting privileges. Members appointed by the Governor shallbe citizens of the Commonwealth.

C. Legislative members and state government officials shall serve termscoincident with their terms of office. All appointments of nonlegislativecitizen members shall be for four-year terms, following the initialstaggering of terms. Appointments to fill vacancies, other than by expirationof a term, shall be for the unexpired terms. Legislative and citizen membersmay be reappointed; however, no citizen member shall serve more than twoconsecutive four-year terms. The remainder of any term to which a member isappointed to fill a vacancy shall not constitute a term in determining themember's term limit. Vacancies shall be filled in the same manner as theoriginal appointments.

Legislative members of the Council shall receive such compensation asprovided in § 30-19.12, and nonlegislative citizen members shall receive suchcompensation as provided in § 2.2-2813 for their services. All members shallbe reimbursed for all reasonable and necessary expenses incurred in theperformance of their duties as provided in §§ 2.2-2813 and 2.2-2825. However,all such compensation and expense payments shall be paid from existingappropriations to the Council.

D. The Council shall elect a chairman and vice-chairman annually from amongits legislative members. A majority of the members of the Council shallconstitute a quorum. The Council shall meet no more than four times a year,upon the call of the chairman or the majority of the members.

E. No recommendation of the Commission shall be adopted if a majority of theSenate members or a majority of the House members appointed to the Commission(i) vote against the recommendation and (ii) vote for the recommendation tofail notwithstanding the majority vote of the Commission.
