§ 30-294. (For contingent expiration, see Editor's note) Membership; terms.

The Commission shall have a total membership of 12 members that shall consistof eight legislative members, two nonlegislative citizen members, and two exofficio members. Members shall be appointed as follows: five members of theHouse of Delegates, to be appointed by the Speaker of the House of Delegatesin accordance with the principles of proportional representation contained inthe Rules of the House of Delegates; three members of the Senate, to beappointed by the Senate Committee on Rules; one nonlegislative citizen memberwho shall represent the Society of the War of 1812 in Virginia, to beappointed by the Speaker of the House of Delegates; and one nonlegislativecitizen member who shall represent the Virginia Society of the NationalSociety, U. S. Daughters of 1812, to be appointed by the Senate Committee onRules. The Librarian of Virginia or her designee and the Superintendent ofPublic Instruction or his designee shall serve ex officio with votingprivileges. Nonlegislative citizen members of the Commission shall becitizens of the Commonwealth. Unless otherwise approved in writing by thechairman of the Commission and the respective Clerk, nonlegislative citizenmembers shall only be reimbursed for travel originating and ending within theCommonwealth for the purpose of attending meetings.

Legislative members and ex officio members of the Commission shall serveterms coincident with their terms of office. Appointments to fill vacancies,other than by expiration of a term, shall be for the unexpired terms.Vacancies shall be filled in the same manner as the original appointments.All members may be reappointed.

Nonlegislative citizen members shall be appointed for a term of two years. Nononlegislative citizen member shall serve more than four consecutive two-yearterms. The remainder of any term to which a member is appointed to fill avacancy shall not constitute a term in determining the member's eligibilityfor reappointment.

The Commission shall elect a chairman and vice-chairman from among itsmembership, who shall be members of the General Assembly.
