§ 33.1-13.1. Policy of the Commonwealth regarding use of highways bymotorcycles; discrimination by political subdivisions prohibited.

In formulating transportation policy; promulgating regulations; allocatingfunds; and planning, designing, constructing, equipping, operating andmaintaining transportation facilities, no action of the CommonwealthTransportation Board, the Commonwealth Transportation Commissioner, or theVirginia Department of Transportation shall in any way have the effect ofdiscriminating against motorcycles, motorcycle operators, or motorcyclepassengers. No regulation or action of the Board, Commissioner or Departmentshall have the effect of enacting a prohibition or imposing a requirementthat applies only to motorcycles or motorcyclists, and the principal purposeof which is to restrict or inhibit access of motorcycles and motorcyclists toany highway, bridge, tunnel, or other transportation facility.

The provisions of this section shall also apply to transportation facilitiesand projects undertaken or operated by counties, cities, towns, and otherpolitical subdivisions of the Commonwealth where public funds have been usedin whole or in part to plan, design, construct, equip, operate, or maintainthe facility or project.
