§ 37.2-704. Commissioner authorized to receive and expend social security andother federal payments for consumers in state facilities.

The Commissioner, under any provision of federal law and regulation and withthe approval of the Governor, may be appointed or function as the agent towhom payments may be made on behalf of any beneficiary in state facilities.These payments shall be expended for the use and benefit of the consumers towhom they would otherwise be payable, and any residue resulting from suchpayments shall be set aside in a special fund to the credit of the consumeron whose account the payment is made. The charges provided for by law for thecare of the consumer shall be defrayed from such payments. The provisions ofsubsection C of § 37.2-705 shall apply to any payments received under thissection.
