§ 38.2-3435. Exclusions.
The provisions of this article shall not apply to:
1. Any health insurance issuer offering group health insurance coverage forany plan year if, on the first day of such plan year, such plan has less thantwo participants who are current employees; or
2. Any health insurance issuer offering group health insurance coverage forany of the excepted benefits.
