§ 45.1-161.292:68. Prosecution of violations.

A. It shall be the duty of every attorney for the Commonwealth to whom theDirector or his authorized representative has reported any violation of thischapter and Chapters 14.5 (§ 45.1-161.293 et seq.) and 14.6 (§ 45.1-161.304et seq.) or on his own initiative to cause proceedings to be prosecuted insuch cases.

B. If the attorney for the Commonwealth declines to cause proceedings to beprosecuted in such cases, the Director may request the Attorney General toinstitute proceedings for any violation of the Act on behalf of theCommonwealth; however, such action shall not preclude the Director frompursuing other applicable statutory procedures. Upon receiving such a requestfrom the Director, the Attorney General shall have the authority to instituteactions and proceedings for violations described in the request.
