§ 45.1-195. Board of Surface Mining Review created; membership; terms;vacancies; chairman; duty.

There is hereby created the Board of Surface Mining Review to be composed ofthree members to be appointed by the Governor, one shall be a minerals otherthan coal surface mining operator who has been engaged in such operationscontinuously for five years preceding his appointment, one shall be aproperty owner who at the time of his appointment owns land or is anexecutive officer of a corporation which owns land upon which minerals otherthan coal surface mining operations have been or are being conducted, and oneshall be a citizen of this Commonwealth having no financial interest in anymining activity. The members shall serve for terms of four years each, exceptappointments to fill vacancies which shall be for unexpired terms, all ofwhom shall hold office at the pleasure of the Governor for their respectiveterms. The Board shall elect its own chairman. The Director or his designatedrepresentative shall serve as secretary to the Board but shall not be amember thereof and shall not participate in or vote upon the deliberations ofthe Board. The sole duty of the Board shall be to hear appeals from ordersissued by the Department under this chapter, and the procedure fordetermining such appeals shall be as provided by § 45.1-194.
