§ 46.2-204. Medical Advisory Board.

For the purpose of enabling the Department of Motor Vehicles to comply withits responsibilities under this title, there is hereby created a MedicalAdvisory Board for the Department. The Board shall consist of seven licensedphysicians currently practicing medicine in Virginia appointed by theGovernor. Appointments to the Board shall be for four-year terms andvacancies shall be filled by appointment for the unexpired portion of a term.The Governor shall designate the chairman of the Board.

The Commissioner may refer to the Board for an advisory opinion the case ofany person applying for a driver's license or renewal thereof, or of anyperson whose license has been suspended or revoked, or of any person beingexamined under the provisions of § 46.2-322, when he has cause to believethat such person suffers from a physical or mental disability or diseasewhich will prevent his exercising reasonable and ordinary control over amotor vehicle while driving it on the highways. In addition, the Board shallassist the Commissioner through the development of medical and healthstandards for use in the issuance of driver's licenses by the Department toavoid the issuance of licenses to persons suffering from any physical ormental disability or disease that will prevent their exercising reasonableand ordinary control over a motor vehicle while driving it on the highways.

The Board shall meet at the pleasure of the Commissioner. Each member shallserve without compensation but shall be reimbursed for his necessary expensesfrom funds appropriated to the Department of Motor Vehicles.
