§ 51.5-2. Plan of cooperation.

The Virginia Office for Protection and Advocacy, Department for the Aging,Department for the Deaf and Hard-of-Hearing, Department of Education,Department of Health, Department of Housing and Community Development,Department of Behavioral Health and Developmental Services, Department ofRehabilitative Services, Department of Social Services, Department for theBlind and Vision Impaired and such other agencies as are designated by theGovernor which serve persons with disabilities shall formulate a plan ofcooperation in accordance with the provisions of this title and the federalRehabilitation Act. The goal of this plan shall be to promote the fair andefficient provision of rehabilitative and other services to persons withdisabilities and to protect the rights of persons with disabilities.

The plan of cooperation shall include an annual update of budgetarycommitment under the plan, specifying how many persons with disabilities, bytype of impairment, will be served under the plan. The plan of cooperationshall include consideration of first pay provisions for entitlement programsof a cooperating agency. If entitlement services are part of a client'sindividualized written rehabilitation program or equivalent plan forservices, funds shall be paid from the entitlement program when possible. Theplan and budgetary commitments shall be reviewed by the respective boards ofthe cooperating agencies, reviewed by the Virginia Board for People withDisabilities and submitted for approval to the appropriate secretaries withinthe Governor's Office before implementation.
