§ 55-376.4. Warning required.

A. The developer, association, or other project professional shall post andmaintain signs that contain the warning notice specified in subsection B. Onesign shall be placed in a clearly visible location at the entrance to theproject and another at the site of the project activity. The warning noticeshall consist of a sign in black letters, with each letter to be a minimum ofone inch in height. Every written contract entered into by a projectprofessional for the providing of professional services, instruction, or therental of equipment to a participant, whether or not the contract involvesproject activities on or off the time-share project or at the site of theproject activity, shall contain in clearly readable print the warning noticespecified in subsection B.

B. The signs and contracts described in subsection A shall contain thefollowing notice of warning:

"WARNING: Under Virginia law, there is no liability for an injury to ordeath of a participant in a project activity conducted at this location ifsuch injury or death results from the inherent risks of the project activity.Inherent risks of project activities include, among others, risks of injuryinherent to land, equipment, and animals, as well as the potential for you toact in a negligent manner that may contribute to your injury or death. Youare assuming the risk of participating in this project activity."

C. Failure to comply with the requirements concerning warning signs andnotices provided in this section shall prevent a project professional frominvoking the privileges of immunity provided by this chapter.
