§ 6.1-122. (Repealed effective October 1, 2010) Embezzlement, fraud, falsestatements, etc., by officer, director, agent or employee of bank, trustcompany or trust subsidiary.

Any officer, director, agent or employee of any bank, trust company or trustsubsidiary who embezzles, abstracts, or willfully misapplies any of themoneys, funds or credits of, or in the possession or control of suchcorporation, shall be guilty of larceny and punished as provided by law. Anyofficer, director, agent or employee of any bank, trust company or trustsubsidiary who issues or puts forth any certificate of deposit, draws anyorder or bill of exchange, makes any acceptance, assigns any note, bond,draft, bill of exchange, mortgage, judgment, decree or other instrument inwriting, or who makes any false entry in any book, report or statement ofsuch bank, trust company or trust subsidiary with intent in any case toinjure or defraud such corporation, or any other company, body politic orcorporate, or any individual person, or to deceive any officer of suchcorporation, or the State Corporation Commission, or any agent or examinerauthorized to examine the affairs of such corporation, and any person, who,with like intent, aids or abets any such officer, director, agent or employeeof such bank, trust company or trust subsidiary in any such violation, shallbe guilty of a felony and upon conviction thereof shall be confined in astate correctional facility not less than one year or more than ten years, orbe confined in jail not exceeding twelve months and fined not exceeding$5,000.

Any such officer who knowingly makes a false statement of the condition ofany such bank or institution, shall be deemed guilty of a felony and uponconviction shall be fined not less than $100 nor more than $5,000, and beimprisoned in a state correctional facility not less than one nor more thanten years.
