§ 60.2-311. Replacing funds lost or expended for unnecessary purposes.

The Commission is authorized and directed to replace in the UnemploymentCompensation Administration Fund, within a reasonable time, out of any fundsappropriated by the General Assembly for such purpose, any moneys received bythe Commission pursuant to the provisions of § 302 of the Social Security Act(42 U.S.C. § 502), which because of any action or contingency (i) are lost or(ii) are expended for purposes other than, or in amounts in excess of thosefound necessary by the Secretary of Labor of the United States for the properadministration of this title. The Commission is directed to report to theGovernor in accordance with the provisions of subdivision 3 of § 2.2-1501 theamount necessary to make such replacement to the Unemployment CompensationAdministration Fund. The Governor shall include in the budget reported to theGeneral Assembly and in the budget bill submitted under § 2.2-1508 the amountnecessary to be appropriated for such purposes.
