Removal of commissioner, when.

115.037. Any commissioner may be removed by the governor formisconduct in office. Before removing a commissioner, the governorshall notify the commissioner in writing of all charges againsthim. Not less than ten days after so notifying a commissioner, thegovernor shall give the commissioner an opportunity to be publiclyheard in person or by counsel in his defense. If a vacancy on anyboard occurs for any reason, the governor shall, with the adviceand consent of the senate, appoint a new commissioner to serve theunexpired term. The new commissioner shall be a member of the samepolitical party as the commissioner he is appointed to replace.
