SECTION 33-9-6

   § 33-9-6  Marking and care of decedent'sgrave. – An executor or administrator of a solvent estate may erect a headstone, andwith the permission of the probate court may erect a monument, and with likepermission an executor or administrator of an insolvent estate may erect aheadstone at the grave of his testator or intestate. An executor oradministrator of a solvent estate may with the permission of the probate courtpay to a cemetery corporation or to a town or city a reasonable sum for theperpetual care of the monument, the headstone, and the lot in which the body ofthe testator or intestate is buried. Where the permission of the probate courtis required, it shall determine the amount of the payment and to whom thepayment shall be paid. All reasonable payments made under this section shall beallowed as part of the funeral charges in the settlement of the accounts of theexecutor or administrator.
