§ 33-9-9 Real estate mortgages as personalproperty. – Debts due by mortgage of real estate and the mortgaged premises shall, unlessthe mortgage be foreclosed and the equity barred in the lifetime of thetestator or intestate, be considered personal property for every purpose insettling the estates of deceased persons.
