When an inmate of the penitentiary escapes therefrom the warden is empowered and has a duty to use every means at his command for the apprehension of such person and, upon recapture, to return him to the penitentiary for the purpose of retaining him in custody until the expiration of his term.2. The recapture of an inmate of the penitentiary who has escaped therefrom is not an arrest for the statutory crime of escape or other crimes committed in effecting the escape.3. The placement of an inmate of the penitentiary in the maximum security section following recapture after an escape is held, for reasons stated in the opinion, not to constitute cruel and unusual punishment.4. Where an inmate who escapes from the penitentiary is recaptured and returned to the penitentiary, he continues under the
