State v. AskjemCriminal No. 870358 Gierke, Justice. The State of North Dakota (State) appeals from the trial court's order granting a new trial pursuant to Rule 33(b), N.D.R.Crim.P. The State argues on appeal that the trial court abused its discretion in granting Eric J. Askjem's motion for new trial. We conclude the trial court did not abuse its discretion and therefore affirm pursuant to Rule 35.1(a)(4), N.D.R.App.P. H.F. Gierke III
