The issue on appeal is whether the trial court erred in denying defendant Vernon Lee Indergaard's motion to suppress evidence of his prior municipal court DUI conviction to preclude its use for enhancement of punishment. There is no dispute that Indergaard was represented by counsel at the time he pleaded guilty in municipal court.

We affirm under Rule 35.1(a)(7), North Dakota Rules of Appellate Procedure; State v. Haverluk, 432 N.W.2d 871 (N.D. 1988); State v. Pitman, 427 N.W.2d 337 (N.D. 1988).
